***** Manjari Nehru Kaul, J. (Oral) Prayer in the petition filed under Section 438 Cr.PC is for grant of anticipatory bail in case FIR No.193 dated 23.07.2019 registered under Sections 307, 323, 324, 364, 120-B, 148, 149 IPC at Police Station City Kapurthala, District Kapurthala.

Learned counsel for the petitioner contends that the petitioner has been falsely implicated in the instant case as the father of the complainant had illicit relations with his wife and he has no role in the alleged offence. He further submits that no recovery has to be effected from the petitioner.

However, a perusal of the FIR reveals that there is specific role attributed to the petitioner, who came to the spot along with four other persons in a car and 10-15 persons on the motorcycles towards Dalbir Singh, father of the complainant, who was standing with his tractor trolley. CRM-M-39843-2019 (O&M) -2Not only this, the petitioner is alleged to have inflicted a datar blow on the head of Dalbir Singh, which is vital part of the body. Learned State counsel has submitted that in view of the serious allegations levelled against the petitioner, his custodial interrogation is required.

Keeping in view the facts and circumstances of the case and without commenting on the merits, no ground for granting anticipatory bail is made out.
