LPA-386-2016 (O&M) (1) The instant Letters Patent Appeal is directed against the order dated 02.09.2015 whereby learned Single Judge has turned down the appellant's claim for admission in the Master of Veterinary Science Course of Animal Husbandry at Guru Angad Dev Veterinary Sciences University, Ludhiana. One of the reasons assigned by the learned Single Judge and rightly so is that the appellant's provisional Degree in Veterinary Science obtained from Sri Ganga Nagar Veterinary College, Sri Ganga Nagar, Rajasthan, statedly affiliated with the Rajasthan V.VISHAL 2016.04.05 13:43 I attest to the accuracy and authenticity of this document
University of Veterinary & Animal Sciences, Bikaner, itself is under clouds, and thus he does not fulfill the minimum eligibility qualification.
(2) Learned Single Judge has found that the above-stated College is not recognized by Veterinary Council of India and the order of Hon'ble Supreme Court passed in respect of students of Apollo College of Veterinary Medicine1 does not apply ipso facto to the students of the subject-College for the reasons mentioned in para-8 of the order under appeal.
(3) Faced with this, learned counsel seeks to withdraw the appeal with liberty to the appellant to approach the appropriate authority/forum in the State of Rajasthan to seek the declaration of validation/recognition of his Degree in Veterinary Science. The question of admission in Postgraduate Degree Course would obviously arise only after the appellant obtains such a declaration. (4) With liberty afore-mentioned, the appeal is dismissed as withdrawn.
