SUVIR SEHGAL, J. (Oral) Through the instant petition, the petitioner seeks anticipatory bail in case FIR No.52 dated 03.04.2019, under Sections 452, 323, 324, 506, 148, 149 of Indian Penal Code, 1860 (Sections 325, 326 and 307 IPC added later on), registered at Police Station Shahkot, District Jalandhar Rural. In compliance of the order dated 29.10.2019, learned State counsel has filed an affidavit. The same is taken on record. Learned State counsel, on instructions from ASI Major Singh submits that the petitioner has joined investigation and is no longer required for custodial interrogation.
In view of the above facts, but without commenting on the merits of the case, the present petition is allowed and the order dated 29.10.2019 granting interim bail to the petitioner is made absolute, subject to the conditions laid down in Section 438 (2) of the Code of Criminal Procedure.
