ARUN MONGA, J. (ORAL) Petition herein is for setting aside impugned order dated 04.03.2011 (Annexure P-5) passed by learned Rent Controller, Nakodar, whereby rent petition filed by the petitioner for ejectment of shop in question, has been dismissed, holding that he is not entitled to seek benefit being an NRI as this petition was filed through his attorney Jaspal Singh. Matter was taken up for hearing on 13.02.2023, when learned counsel for petitioner sought time to implead legal heirs of petitioner who had died during the pendency of instant proceedings. On resumed hearing today, learned counsel for petitioner seeks more time to implead legal heirs of petitioner.
It seems that legal heirs of petitioner are not interested in pursuing the instant revision petition as neither the legal heirs nor learned counsel representing deceased petitioner have taken any steps to implead SHALINI BHATIA 2023.04.29 15:10 I attest to the accuracy and integrity of this order/ judgment
CR No. 2422 of 2011 -2them. Even otherwise also, if the revision petition is entertained, the ground of seeking benefit as NRI is not available with legal heirs of the petitioner.
Be that as it may, instant revision petition is dismissed for non-prosecution with liberty to the legal heirs to revive the same if they wish to do so at a later stage.
