HON'BLE MR. JUSTICE SUVIR SEHGAL Present:- Mr. K.K.Thakur, Advocate, for the petitioner. SUVIR SEHGAL, J. (Oral) Instant petition has been filed under Section 482 Cr.P.C for issuance of direction to the official respondents No.1 to 3 to take appropriate legal action against private respondents No.4 to 6 for kidnapping the daughter of the petitioner. Another prayer has been made for directing respondents No.2 and 3 to decide the representations submitted by the petitioner.

Counsel for the petitioner submits that the petitioner was married to respondent No.4 on 15.01.2012 and a daughter was born out of the wedlock. He submits that husband of the petitioner, who was drugaddict and used to harass the petitioner, turned her and the minor child out of the matrimonial home. Counsel submits that the petitioner started residing with her parents and instituted a petition under Protection of Women from Domestic Violence Act, 2005 (Annexure P-1) and a complaint against the private respondents under Section 406, 498-A and 420 of Indian Penal Code, 1860. By referring to the averments made in the petition, he

CRM-M-50683 of 2021 {2} submits that on 19.11.2021, the private respondents alongwith some unknown persons with muffled faces attacked the mother of the petitioner after forcibly entering their house and snatched some gold articles and forcibly took away the daughter of the petitioner. He submits that there is a CCTV footage (Annexure P-2) of the incident and despite representations, Annexures P-3 and P-4, no action has been taken by the official respondents. Counsel submits that the petitioner would be satisfied in case a direction is issued to the concerned official respondents to look into the representations.

Request of counsel for the petitioner has been considered. Without examining the allegations' levelled in the petition or in the representations, the present petition is disposed of with a direction to the Senior Superintendent of Police, District Ferozepur-respondent No.2 to examine the representation dated 20.11.2021 (Annexure P-4) and thereafter, to take appropriate steps as warranted, in accordance with law. A copy of this order alongwith copy of representation, Annexure P-4 be sent to the Senior Superintendent of Police, District Ferozepur, respondent No.2 to enable him to do the needful expeditiously.
