Megha v. State Of Haryana And Another
IN THE HIGH COURT OF PUNJAB & HARYANA, CHANDIGARH
Sr. No.: 119 Civil Writ Petition No.20004 of 2023 Date of Decision: September 12, 2023 Megha ..... PETITIONER(S)
VERSUS
State of Haryana and another ..... RESPONDENT(S) . . .
CORAM:
HON'BLE MR. JUSTICE TRIBHUVAN DAHIYA . . .
PRESENT: - Mr. Brijesh Kumar, Advocate with Mr. Kushager Goyal, Advocate for the petitioner.
. . .
Tribhuvan Dahiya, J. (Oral) This petition has been filed seeking a writ of certiorari quashing the condition in advertisement No.26 of 2023 dated 24.06.2023, Annexure P-5, which requires the candidates who had applied in response to earlier advertisement No.32 of 2022 dated 19.11.2022, Annexure P-1, to apply afresh.
2.
Learned counsel for the petitioner contends that the petitioner was an applicant in response to the earlier advertisement No.32 of 2022 issued by the respondents for the Post Graduate Teachers (PGTs) in the subject of Computer Science for the rest of Haryana Cadre. The advertisement was withdrawn on 24.05.2023, and a fresh advertisement, i.e. advertisement No.26 of 2023, was issued for the posts on 24.06.2023. Neither the petitioner came to know about these facts, nor was the fee deposited by him refunded. Therefore, he should now be allowed to submit
2023:PHHC:119285 CWP No.20004 of 2023 [2] application for the post in response to advertisement No.26 of 2023. 3.
Heard.
4.
Undisputedly, closing date to submit applications in response to the advertisement in question was 18.07.2023, which has already passed. Merely because the petitioner could not keep himself updated and did not come to know about the advertisement, he cannot be permitted now to submit the applications beyond the cut-off date. This Court has already held in Civil Writ Petition No.5864 of 2023, titled Annu Vs. State of Haryana and others, that cut-off date for submission of application cannot be extended on such grounds.
5.
Dismissed.
