The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of order dated 23.08.2023 (Annexure P-14) whereby application of the petitioner with respect to passport has been closed.

Learned counsel for Union of India, at the outset, submits that criminal proceedings arising out of FIR No. 123 dated 27.06.2020, under Section 283 of IPC and Section 72-C of the Punjab Excise Act, 1914 (Haryana Amendment Bill, 2020), registered against the petitioner at Police Station Rajaund, District Kaithal, are pending. CWP No.19692 of 2023 -2- 2023:PHHC:117330 investigation has already filed challan, thus, petitioner is supposed to get prior approval from trial court in terms of Notification No. 570 dated 25.08.1993.

Faced with this, learned counsel for the petitioner seeks permission to withdraw the instant petition with liberty to approach trial court in terms of the afore-stated Notification. 4.

In the wake of statements of both sides, the present petition is disposed of with liberty to the petitioner to approach trial court in terms of afore-stated Notification. If the petitioner moves an application in terms of the afore-stated Notification, trial court is requested to decide the said application expeditiously.
