The present petition has been filed under Section 482 of the Code of Criminal Procedure for quashing of impugned complaint dated 10.01.2020 CIS No.COMA/11/2020 titled as Municipal Council vs. Roshan Lal along with summoning order dated 10.01.2020, Annexure P-1. 2.

After arguing for some time, learned counsel for the petitioner prays for withdrawal of the instant petition with liberty to raise all pleas before the trial Court at the appropriate stage. He however, prays that the trial Court be directed to grant exemption to the petitioner from personal appearance as petitioner is 65 years old and suffering from old-age ailments regarding which medical record of Fortis Hospital has been appended as Annexure P-4. His application for discharge is also pending. He is ready to furnish an undertaking by way of affidavit to appear before the trial Court on the dates, for which his presence is absolutely necessary.

Dismissed as withdrawn with liberty aforesaid. 4.

In case the petitioner files an application for grant of exemption from personal appearance, the trial Court shall sympathetically consider the same keeping in view the aforesaid facts.
