(ORAL) Petitioner is seeking the concession of anticipatory bail under Section 438 of the Cr.P.C. in case FIR No.121 dated 20.06.2023 under Sections 420, 379, 411, 120-B of the IPC registered at Police Station Lambi, District Sri Muktsar Sahib. While issuing notice of motion on 11.09.

2023, following contentions of learned counsel for the petitioner were recorded:- "Learned counsel for the petitioner inter alia contends that a secret information was received qua involvement of the petitioner in the crime in question and subsequently a disclosure statement was also suffered by co-accused, however, there was no material on record, which could even remotely connect the petitioner with the co-accused who had allegedly been taking tractor trolleys on loan and thereafter filing false complaints by fabricating a story that those vehicles had been stolen. Learned counsel submits that the petitioner has clean antecedents which gives further credence to his false implication in the case in hand." Thereafter, vide order dated 25.09.

2023, the petitioner had been granted interim anticipatory bail with direction to join PUNEET SACHDEVA 2023.12.12 18:31 I attest to the accuracy and integrity of this document.

Learned counsel for the petitioner submits that in compliance of order dated 25.09.2023, the petitioner has joined investigation and cooperated with the investigating agency. Learned State counsel, on instructions from ASI Karnail Singh, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He on further instructions submits that the petitioner is not required for further investigation much less for his custodial interrogation. In view of the above, the petition is allowed and interim order dated 25.09.2023 is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C.
