The petitioner apprehending his arrest in the FIR captioned above, has come up before this Court under Section 438 CrPC seeking anticipatory bail. 2.

In para No.16 of the petition, the petitioner has mentioned 04 cases pending against him, on the other hand, as per State counsel the petitioner is involved in 04 more cases and in two cases, he has been convicted. However, the legal requirement is that the petitioner has to mention his criminal antecedents of pending FIRs or where he is convicted. There is no need to mention about the cases where the FIR is cancelled, or the accused has been discharged or has been acquitted. 3.

On this, counsel for the petitioner wants to withdraw the present petition with liberty to file fresh with better particulars mentioning details of all criminal cases in which he is involved.

Given above, the present is disposed of as withdrawn with liberty reserved to the petitioner to file fresh mentioning all the FIRs pending anywhere against the petitioner.
