(Oral) The present petition has been filed under Article 226 of the Constitution of India inter alia seeking issuance of a writ in the nature of Certiorari for setting aside order dated 23.10.2024 (Annexure P-9) passed by learned Commissioner & Secretary to Government of Haryana, Development and Panchayats Department, whereby he has set aside order dated 30.12.2022 passed by the Block Development and Panchayat Officer, Thanesar, District Kurukshetra (respondent No.4) as also the order dated 19.07.2023 (Annexure P-6) passed by learned Deputy Commissioner, Kurukshetra, directing recovery of Rs. 22,89,181/- from the former Sarpanch (respondent No.5) and the matter has been remanded to the Deputy Commissioner, Kurukshetra for deciding the matter afresh within a period of two months.

At the outset, learned counsel for the petitioner submits that the petitioner restricts his prayer to the extent that despite the direction issued vide order dated 23.10.2024 (Annexure P-9) that the case be decided by the HIMANI GUPTA 2025.07.31 09:43 I attest to the accuracy and integrity of this document

Learned State counsel, on instructions from Mr. Amit Kumar, Block Development and Panchayat Officer, Thanesar, submits that the Deputy Commissioner has already marked an inquiry into the matter and the matter is presently being inquired into by a Committee headed by Sub Divisional Magistrate, Thanesar and in all probability, the final inquiry report would be submitted within a period of four weeks from today. 5.

Keeping in view the aforesaid stand taken by learned State counsel, no further orders are required to be passed in the instant writ petition at this stage, accordingly, the present petition stands disposed of. 6.
