(Oral) After making submissions at length by the two sides, counsel for the appellant, faced with the likely consequences has made statement for permission to withdraw the present appeal reserving the right of the plaintiff-appellant to file appropriate relief by way of suit for recovery and has also prayed refund of the court fee. In the light of this prayer made by counsel for the appellant, he is allowed to withdraw the present appeal. The same stands dismissed as withdrawn. However, the appellant's right to refund of the court fee as per the rules will be subject to the prescribed rules.
