The limited prayer for which the petitioners have come up before this Court is to exempt their personal appearance before the trial Court on the ground that petitioner no.1 is women of 60 years of age and suffering from various ailments, whereas petitioner no.2 looks after her. They are staying at Madhya Pradesh and thus, it is quite difficult for them to travel frequently, as lot of money is spent in frequent traveling.

Learned senior counsel appearing for the petitioners submit that the petitioners undertake not to claim any prejudice in case they are permitted to appear before the trial Court through their counsel. Once the petitioners have given an undertaking not to claim any prejudice, there is no reason to force their personal appearance on each and every date.

Given above, the petitioners are granted exemption from their personal appearance before the trial Court on each and every date except at the ASHWANI KUMAR 2022.10.14 11:31 I attest to the accuracy and integrity of this order/judgment
