The petitioner challenges the promotions granted on the post of Master Cadre from JBT in the year 2015 and 2016, by preferring this writ petition in the year 2023.

No plausible explanation has come forward for waiting for almost seven years in not challenging the promotions granted to so-called junior persons of the petitioner.

Learned counsel for the petitioner submits that the petitioner had demanded her promotion but the department stated that the seniority list of the master cadre is under challenge before the High Court and, therefore, she did not approach this Court.

The seniority list relating to master cadre has no relevance with regard to the promotion from the lower post to that of master cadre. The respondents have already been working on the higher post for more than seven years now.

The Hon'ble Supreme Court in the case of State of Uttar Pradesh and others vs. Rajmati Singh 2022 INSC 1261, has held that in service matters the period of limitation is a relevant factor and things which have already been settled ought not be unsettled after a certain period of time.
