Likhi Singh v. State Of Haryana
IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH R.F.A No. 1502 of 2015 (O&M) Date of decision : 22.12.2015 Likhi Singh ..... Appellant vs State of Haryana .... Respondent Coram:
Hon'ble Mr. Justice Rajesh Bindal
Present:
Mr. Rajiv Sharma, Advocate for the landowner. Ms. Vibha Tewari, Assistant Advocate General, Haryana. Rajesh Bindal J.
Present appeal has been filed impugning the award passed by the Land Acquisition Collector (for short, 'the Collector') in an application filed under Section 28A of the Land Acquisition Act, 1894 (for short, 'the Act'). Along with the appeal an application seeking condonation of delay of 305 days in filing thereof has also been filed. Learned counsel for the appellant could not dispute the fact that against the award of the Collector in an application filed under Section 28A of the Act, appeal is not maintainable before this Court, as the Act clearly provides for remedies against that. Reference can also be made to the judgment of this Court in RFA No.6990 of 2013-Ompal v. State of Haryana and others, decided on 1.7.2015 For the reasons mentioned above, the appeal as well the application seeking condonation of delay are dismissed. 22.12.2015 (Rajesh Bindal) sharmila Judge SHARMILA 2016.01.05 11:24 I attest to the accuracy and authenticity of this document.
