*** DEEPAK GUPTA, J. (ORAL) Prayer in this petition filed under Section 482 Cr.P.C. is for quashing the order dated 16.08.2023 passed by Addl. Sessions Judge, Amritsar whereby bail of the petitioner has been cancelled in F.I.R. No.284 dated 10.09.2020, registered under Sections 307, 120-B, 34 IPC (Section 25 of the Arms, Section 25 (6,7,8), 54, 59 of Arms Act were added later on) at Police Station Maqboolpura District Amritsar.

Learned counsel for the petitioner contends that petitioner was allowed bail by a co-ordinate Bench of this Court vide order dated 26.04.2022 in CRM-M-9482-2022 (O&M) (Annexure P-1). He submits that the petitioner appeared before the trial court on each and every occasion as reflected in the orders (Annexure P-2). However, due to mis-understanding of the date, petitioner could not appear on 16.08.2023 due to which his bail was cancelled.  Learned counsel submits that the petitioner is ready to surrender before the trial Court and that he be granted necessary protection till then. This petition is disposed of with a direction to the petitioner to surrender before the trial court on or before 12.09.2023 the date already fixed thereat. On his such surrender, the trial court shall initiate proceedings under Section 446 Cr.P.C. against the petitioner. The petitioner shall not be taken into custody till the disposal of those proceedings and after disposal thereof, the petitioner shall be admitted to bail. If in the meantime, the petitioner is sought to be arrested on account of warrant of arrest having been issued, he shall be admitted to interim bail
