(Oral) The present petition has been filed under Article 226 of the Constitution of India inter alia seeking issuance of a writ in the nature of Certiorari for setting aside order dated 23.10.2024 (Annexure P-9) passed by learned Commissioner & Secretary to Government of Haryana, Development and Panchayats Department, whereby he has set aside order dated 02.07.2021 (Annexure P-3) passed by the Block Development and Panchayat Officer, Thanesar, District Kurukshetra (respondent No.4) as also the order dated 21.09.2022 (Annexure P-4) passed by the Deputy Commissioner, Kurukshetra directing recovery of Rs. 21,00,000/- from the former Sarpanch (respondent No.5) and the matter has been remanded to the Deputy Commissioner, Kurukshetra for deciding the matter afresh within a period of two months.

Learned counsel for the petitioner submits that despite the direction issued vide order dated 23.10.2024 (Annexure P-9) that the case be decided by the Deputy Commissioner, Kurukshetra within a period of two HIMANI GUPTA 2025.07.30 14:44 I attest to the accuracy and integrity of this document

CWP-20638-2025 (O&M) - - months; the same has not been done despite lapse of more than nine months. He submits that he restricts his prayer for time bound directions to Deputy Commissioner to decide the case remanded to him by learned Commissioner vide order 23.10.2024 (Annexure P-9).

Learned State counsel, on instructions from Mr. Amit Kumar, Block Development and Panchayat Officer, Thanesar, submits that the Deputy Commissioner has already marked an inquiry into the matter and the matter is presently being inquired into by a Committee headed by Sub Divisional Magistrate, Thanesar and in all probability, the final inquiry report would be submitted within a period of four weeks from today. 5.

Keeping in view the aforesaid stand taken by learned State counsel, no further orders are required to be passed in the instant writ petition at this stage, accordingly, the present petition stands disposed of. 6.
