**** HARSIMRAN SINGH SETHI, J. (Oral) In the present petition, the claim of the petitioner is that he is senior to the private respondents and is eligible for the promotion to the post of Yard Master from the post of Driver, hence, he should have been given preference in promotion.

Learned counsel for the respondents submits that initially the services of the petitioner were to be regularized in the year 1988, but the said order was amended vide order dated 11.01.2018 and the services of the petitioner were directed to be regularized from the year 1991 which order has been challenged by the petitioner in CWP No. 29704 of 2018 which is still pending consideration, hence, once, the claim of the petitioner for regularization of his service from the year 1988 is pending consideration with the respondents, the petitioner cannot be treated senior to the private respondents who's service was regularized in 1989 and in case, the petitioner succeed in the said writ petition No. 29704 of 2018, the claim of the petitioner for promotion to the post of Yard Master from the post of Driver w.e.f the date juniors were promoted, will be considered in accordance with RIYA 2024.04.19 09:41 I attest to the accuracy and integrity of this document

Learned counsel for the petitioner submits that keeping in view the statement made by learned counsel for the respondents-State recorded herein above, no further grievance of the petitioner exist, hence, the present petition may kindly be disposed of having been not pressed any further.
