(Oral) CRM-M-50905-2021 By this petition, the petitioners seek quashing of FIR No.377, dated 03.12.2020, registered at Police Station Sector-39, Chandigarh, alleging therein the commission of offences punishable under the provisions of Sections 420/120-B the IPC, as also all other subsequent proceedings arising therefrom, on the basis of a compromise (copy Annexure P-2), arrived at between the petitioners and respondent no.2.

CRM-M-50905-2021 & -2 Pursuant to the order of this court dated 06.12.2021, a report has been received from the learned JMIC, Chandigarh, dated 17.02.2022, stating that the complainant in the FIR, i.e. respondent no.2, Partap Singh Chauhan, appeared before that court and got recorded his statement that the matter having been amicably settled between him and the accused persons, i.e. the four petitioners in this petition, (Kuldeep Kaur, Jagdeep Singh, Amanpreet Kaur and Satbir Kaur), in terms of the compromise deed dated 22.11.2021, and that he has also received the remaining amount of Rs.6.05 lakhs (in terms of the said settlement), consequently he has no objection if the FIR in question is quashed.

The petitioners are also stated to have got recorded similar statements before that court.

The statement of SI Satinder Singh was also recorded before that court to the effect that there were four accused in the FIR and that there is no other person involved in the occurrence as is not a party to the present petition. Today, learned counsel for the complainant/respondent no.2 appears and submits that the compromise between the parties still subsists. That being so, looking at the nature of the offences alleged to have been committed by the petitioner, and the fact that the matter has been compromised between the petitioners and the complainant, the present petition is allowed and FIR No.377, dated 03.12.2020, registered at Police Station Sector-39, Chandigarh, alleging therein the commission of offences punishable under the provisions of Sections 420/120-B the IPC, along with all proceedings emanating therefrom, is hereby quashed.

CRM-M-50905-2021 & -3Vide this petition, the petitioner sought to be admitted to interim bail in the context of the FIR in question with her having been so admitted to interim bail vide the same order dated 06.12.2021. In view of the fact that the FIR itself has been quashed as stated hereinabove, this petition has been rendered infructuous and is disposed of as such.

The power of attorney filed by learned counsel for respondent no.2 in both the cases is ordered to be taken on record. (A photocopy of this order be placed on the file of the connected case).
