(Oral) Learned counsel for the appellants states that pursuant to the observations made by this Court, the authorities have sympathetically reconsidered the whole matter and the Competent Authority has approved the engagement of respondent on compassionate ground under the Direct Payment System Worker. He states that appointment letter has been issued to the respondent yesterday.

Since the authorities have acted in a fair manner, we modify the order under appeal to the extent of imposition of cost of Rs.25,000/- by the learned Single Judge. In this regard, we have not issued notice to the respondent for the reason that cost of litigation might be more than the amount of cost as awarded in his favour. However, if the respondent still has any grievance, he may approach this Court for modification of this order.

The appeals stands disposed of accordingly.
