The peƟƟoner apprehending arrest in the FIR capƟoned above, has come up before this Court under SecƟon 438 of Code of Criminal Procedure, 1973 (CrPC) seeking anƟcipatory bail.

Vide order dated 07.11.2022, this Court had granted interim bail to the peƟƟoner.

Counsel for the peƟƟoner sought bail on the grounds that the peƟƟoner is the aƩesƟng witness to the sale deed dated 06.10.2008 and was not a beneficiary. Further, he already joined the invesƟgaƟon and there is no allegaƟon against him that he hampered with the invesƟgaƟon.

State as well as counsel for the complainant submits that the peƟƟoner is a member of gang and earlier similar FIR had also been registered against them which they later on compromised with the complainant. Due to compromise, trial Court acquiƩed them. PeƟƟoner in connivance with main accused, who was impostor JYOTI 2023.05.12 10:28 I attest to the accuracy and integrity of this order/judgment.

CRM-M-46456-2022 transferred the property of deceased and by mis-represenƟng commit this fraud. Later on 08 kanals of the transferred land was further sold to difference persons. 5.

Considering the peƟƟoner's role and in the enƟrety of facts and circumstances, there is no case to recall the order of interim bail already granted and furthermore there is no allegaƟon that he tempered with the evidence or hampered with the invesƟgaƟon.

Given above, the present peƟƟon is allowed and interim order dated 07.11.2022 is made absolute. All pending miscellaneous applicaƟons, if any, stand disposed of. (ANOOP CHITKARA) JUDGE 11.05.2023 JyoƟ-II Whether speaking/reasoned:
