RAJESH BHARDWAJ, J.(ORAL) Petitioners have approached this Court praying for issuance of direction to respondent No.3, i.e. Sub Divisional Officer (Civil)-cumAllotment Authority/Prescribed Authority, Rohtak, to issue Form U.S.-4 to the petitioners regarding the land measuring 27 Kanalas, situated in village Bhaiyapur, Tehsil and District Rohtak, originally allotted to Kundan, the predecessor of the petitioners, by the Allotment Authority, Rohtak, vide Form U.S.-3 dated 01.06.1978, Annexures P-1, and to direct respondent No.2, i.e. Tehsildar, Rohtak to enter and sanction mutation of the aforesaid land in favour of the petitioners and further to direct respondent No.

3 to deliver possession of the aforesaid allotted land to the petitioners at the spot in accordance with the provisions of Para 8-A and 10 of the Haryana Utilization of Surplus and Other Areas Scheme, 1976. It has been contended by counsel for the petitioners that for redressal of their grievances, the petitioners have already given Legal Notice, Annexure P-4, to respondent No.3, on 22.06.2023 but the same has MEENU 2023.09.

Notice of motion to official respondents only at this stage. On asking of the Court, Ms.Upasana Dhawan, AAG, Haryana, who is present in Court, accepts notice on behalf of the respondents/State. After hearing counsel for the parties and going through the facts and circumstances of the case, the present petition is disposed of with a direction to respondent No.3, i.e. Sub Divisional Officer (Civil)-cumAllotment Authority/Prescribed Authority, Rohtak, Tehsil and District Rohtak, to decide the Legal Notice, dated 22.06.2023, Annexure P-4, expeditiously in accordance with law preferably within one month from the date of receipt of certified copy of this order.
