SANDEEP MOUDGIL, J (ORAL) The jurisdiction of this Court has been invoked under Section 226 of the Constitution praying for issuance of a writ in the nature of mandamus directing respondent Nos.2 & 3 for protecting the life and liberty of the petitioners by providing police protection and not to harass them illegally at the behest of private respondents.
Learned State Counsel has submitted that a speaking order has already been passed on the complaint of the petitioners by the authorities concerned and has produced the copy of the same, which is taken on record. He has furnished a copy of the order to counsel for the petitioners. The relevant part of the speaking order is reproduced below :- "During enquiry, on dated 24.07.2025 statement of petitioner No.1-Ninder Kaur has taken, in which she stated that she became in relation with petitioner No.2-Soni Singh S/o Kesar Singh R/o Village Mehon, P.S Julkan, Patiala three years ago. However, now Petitioner No.1-Ninder Kaur desires to reside with her husband respondent No.4-Mohan Singh and do not MANOJ KUMAR 2025.07.26 05:04 I attest to the accuracy and authenticity of this order
CRWP-7962-2025 even want continue any contact with petitioner No.2Soni Singh as well as want to close her protection petition No.CRWP-7962-2025. Petitioner No.1Ninder Kaur has taken this decision with her own will without any pressure.
Besides this, shared statement of respondent No.4Mohan Singh S/o Jaswant Singh, respondent No.5 Khadak Singh S/o Tarru Singh, respondent No.7Ranjeet Singh S/o Didar Singh has taken, in which they stated that petitioner No.1 Ninder Kaur got married with respondent No.4 Mohan Singh thirteen years ago and they have two children (one daughter named Rajwinder Kaur aged 13 years and one son named Navjot Singh aged 7 years). Respondents came to know that petitioner No.1 have relation with petitioner No.2-Soni. But, now petitioner No.1-Ninder Kaur wants to stay with her husband Mohan Singh, with which respondents are agreed. They never tortured petitioner No.1 Ninder Kaur before and will never torture in future. Petitioner No.1 Ninder Kaur has not any threat from them."
In light of the above, counsel for the petitioners does not wish to press this petition further. The petitioners would be at liberty to file appeal, as is stipulated in the Standard Operating Procedure, in the light of notification No. HOMEHM-40 40SECM/14/2025-2H4/63 dated 23.01.2025 issued by the Department of Home Affairs, Punjab, Government of Punjab (Home-4 Branch), in case of any grievance left.
Petition stands dismissed as not pressed.
