(Oral) Learned counsel for the parties are ad idem that the present case may be remanded in view of the judgment of this Court in case of Krishan Kumar & Ors. vs. Kamla Devi & Ors. [2016 (5) RCR (Civil) 1019] with liberty to respondent no.1-landlord to file an application for amendment, which shall be decided in view of the law laid down in the case of Krishan Kumar (supra).

In view of the above, the present revision petition is allowed and the impugned order of eviction of the petitioner is set aside. The matter is remanded to the Rent Controller with the liberty aforesaid. The Rent Controller is requested to decide the case as expeditiously as possible, in accordance with law. Pending applications, if any, also stand disposed off.
