Neeraj Kumar v. State Of Haryana And Others
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CWP No. 27046-2019 (O&M) Date of decision: 13.07.2022 Neeraj Kumar
...Petitioner
Versus
State of Haryana and others
...Respondents
CORAM: HON'BLE MR. JUSTICE ARUN MONGA Present :
Mr. Balram Singh, Advocate, For the petitioner.
Mr. Saurabh Mohunta, DAG, Haryana.
Mr. R.K.Malik, Senior Advocate with Mr. Sandeep Dhull, Advocate, For respondent No.3.
**** ARUN MONGA, J. (ORAL) Challenge herein is to the order dated 28.09.2018 (Annexure P-5), vide which respondent No.3 has allegedly been shown senior to the petitioner. It transpires that during pendency of the writ proceedings, respondent No.3 has given up his seniority on the post in question and, in fact, has left the post in question and instead joined as Kanungo. Grievance of the petitioner of his being shown junior to him thus stands mitigated.
By sheer fortuitous circumstances, nothing survives for adjudication before this Court. Writ petition is, accordingly, rendered infructuous and disposed of accordingly.
It is expected of the respondents that since the respondent No.3 has given up his seniority, they will take appropriate steps to re-draw the seniority list and give benefit to the deserving candidates below him by revising their seniority.
