The matter pertains to the year 2017. Perusal of the ordersheets reveals that none had put in appearance for the appellant on the last two dates of hearing. Accordingly, vide last order dated 22.09.2025, notice was issued to the appellant.

Office report indicates that the appellant is duly served. But today, none has put in appearance on behalf of the appellant. 3.

In view of the aforesaid premise, issuance of fresh notice to the appellant would be a futile exercise. It appears that due to sheer long pendency of the present appeal before this Court for a period of more than 9 years, the appellant has lost interest in pursuing the same, as no attempt has been made by him to contact his counsel or to engage a new counsel. It is, therefore, clear that the appellant is not seriously interested in pursuing the present matter.

Be that as it may, the instant appeal is dismissed for nonprosecution, however, with liberty to the appellant to move an appropriate application within a period of 04 weeks from today for reviving the same, if so, advised.
