**** SANJAY VASHISTH , J. (Oral) Instant petition has been filed under Section 528 of the BNSS, 2023 (earlier Section 482 Cr.P.C.), seeking quashing of the below detailed First Information Report (FIR), and all the consequential proceedings arising therefrom, on the basis of the compromise dated 02.06.2025 (Annexure P-2), effected between the parties.

Date Section(s) Police Station District 25.04.2025 318(4) of BNS, 2023 Sarai Amant Khan Tarn Taran Vide order dated 23.07.2025, the affected parties were directed to appear before the learned trial Court/Illaqa Magistrate for getting their respective statements recorded with regard to the compromise. Since, there is no representation on behalf of the parties, however, for reference, relevant extract of the report received from the concerned trial Court/Illaqa Magistrate, qua the factum of compromise, is

From the statement of the parties and investigating officer, the report is submitted as under:- As per the statement of parties and investigating officer, the present FIR there is only one person arrayed as accused namely A Jagdeep Singh in the petition.
As per the statement of parties and investigating officer, there is only one accused person namely Jagdeep Singh who has filed the petition.
As per the statement of petitioner and investigating officer, accused has not been declared as proclaimed offender and petitioner/accused is not involved in any other criminal case or FIR.

The parties suffered their statements voluntarily, with their free will, without any pressure, threat or coercion before the Court to the effect that they have compromised their dispute with the intervention of respectable of locality, which seems to be genuine.

As per the statement of petitioner and investigating officer, petitioner/accused is not involved in any other criminal case or FIR.

As per the statement of parties and investigating officer, complainant is the only victim in this case.

As per statement of investigating officer and record, there is only one victim/complainant in this case and he has been impleaded as respondent in the present case.

Report has since been received from learned Judicial Magistrate Ist Class, Tarn Taran, in pursuance to the directions of this Court wherein, the factum of the compromise arrived at between the parties stands verified and confirmed. As per the report(s) compromise has indeed been effected between the parties and the same is without any pressure or coercion and out of their free will and the private respondents have also made statement to the effect that they would have no objection if the FIR qua the accusedpetitioners is quashed.

The trial Court has annexed the statements of the parties in original, along with its report. The relevant part of the said report is reproduced here-below:

Learned State counsel too submits that there are no other accused other than the petitioners and the private respondents are the only aggrieved person in the FIR in question.

In view of the report of the learned Judicial Magistrate First Class, Tarn Taran, and the principles laid down by Hon'ble the Apex Court in Gian Singh Vs. State of Punjab and others (2012) 10 SCC 303, and also by the Full Bench of this Court in Kulwinder Singh and others Vs. State of Punjab and another, 2007(3) RCR (Criminal) 1052, the instant petition is allowed. The aforesaid FIR and all consequential proceedings arising out of

Needless to say that the parties shall remain bound by the terms of compromise and their statements recorded before the Court below. 9.
Petition stands disposed of.
