The present petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 seeking quashing of order dated 28.05.2024 (Annexure P-7) passed by learned Judge Special Court, Moga, in FIR No.156 dated 15.11.2018 (Annexure P-1) under Section 22 of NDPS Act, 1985 registered at Police Station Kot Ise Khan, District Moga, whereby bail of the petitioner was cancelled and his surety/ bail bonds were forefeited and the petitioner was summoned through non bailable warrants of arrest. 2.

Learned counsel for the petitioner contends that the petitioner was regularly appearing before the trial Court, however, he could not appear before the said Court on 13.05.2025 and 28.05.2025 as he was wrongly involved in another FIR No.73 dated 06.05.2025 under Section 21 of NDPS Act, 1985 registered at Police Station Kot Ise Khan, Moga. However, later on, he was granted regular bail vide order dated 13.06.2025 passed by the trial Court concerned. He on instructions, further submits that the petitioner now undertakes to appear before Sonia Puri 2025.07.25 18:32 I attest to the accuracy and integrity of this document

CRM-M No.39114 of 2025 -2-   the trial Court on each and every date of hearing and shall not seek exemption from his personal appearance, on any ground.  3.

Notice of motion.

On the asking of the Court, Mr. Gautam Thapar, Sr. DAG, Punjab, accepts notice on behalf of the respondent-State. 5.

In view of the limited prayer made by the learned counsel for the petitioner, the instant petition is disposed of subject to the condition that the petitioner shall surrender before the Court concerned at 10:00 am within 07 days from the date of receipt of this order and on his doing so, he moves an application for bail, the Court concerned shall decide the same on the same very day, in accordance with law.

It is made clear that in case, the petitioner fails to surrender before the Court concerned within the given period of time, this order shall be of no avail to him thereafter.

The petition stands disposed of.
