(Oral) The petitioner prays for grant of anticipatory bail in FIR No. 153 dated 1.8.2019 registered under Section 420 IPC at Police Station Haibowal, District Ludhiana.

The operative part of the order dated 19.9.2019, vide which the petitioner has been granted interim bail, is reproduced below: "Learned counsel for the petitioner submits that as per allegations in the FIR, petitioner Harjinder Singh @ Bitu, being power of attorney of one Gulzari Lal, father-in-law of purchasers Karamjit Singh and Hans Raj, brother of other purchaser, had entered into a full and final payment agreement with the complainants for the sale of two plots of 158 square yards each in the year 2009. It is further submitted that 10 years thereafter, original owner Kuljit Singh has filed two civil suits challenging transfer of land and the said suits are pending and the present FIR has been registered thereafter, with the allegations that the petitioner has not executed the sale deed. Learned counsel for the petitioner submits that the petitioner, in pursuance to the order dated 19.9.2019, has already appeared before the Investigating Officer and joined the investigation. Learned counsel for the State, on instructions from HC Sanjeev Bhagethan has not disputed the factual position and submits that the petitioner has joined the investigation and is no more required for any further investigation.

In view of the above, the petition is allowed and the interim bail granted to the petitioner, vide order dated 19.9.2019, is made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C.
