(ORAL) Prayer in this 1st petition under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (B.N.S.S.) is for grant of regular bail to the petitioner in case FIR No. 121 dated 24.06.2023 registered under Sections 376, 376-C, 506 and 120-B IPC and Section 6 of POCSO Act (Section 376-D, 120-B IPC deleted later on vide DDR No. 31 dated 16.01.2024), registered at Police Station Talwandi Sabo, District Bathinda, Punjab.

Custody certificate dated 03.09.2024 filed in Court today is taken on record, as per which, the petitioner has undergone the custody period of 1 year and 2 months as an undertrial. After arguing for sometime, when this Court is not inclined to accord the benefit of regular bail to the petitioner; learned counsel submits that he may be permitted to withdraw the present petition, at this stage.
