This petition has been filed under Section 528 of BNSS for issuance of directions to respondents No. 2 and 3 to conduct free, fair and impartial enquiry in FIR No. 0004 dated 31.01.2025 under Sections 103,191(3), 190 of BNS registered at Police Station Behrampur, District Gurdaspur, Punjab and to arrest private respondents No. 4 to 9 who are having good relations with the investigating team with a further prayer to transfer the investigation from District Gurdaspur to any otherDistrict. 2.
Learned counsel for the petitioner contends that the petitioner has got registered an FIR against the private respondents and only respondent No. 8 has been arrested till date and no action against the remaining private respondents has been initiated by the investigating agency because of the pressure of respondent No. 9 who is the close associate and one of the main accused in the FIR. CRM-M-39049-2025 submits that he would be satisfied if directions are issued to respondents No. 2 and 3 to conduct free, fair and impartial enquiry in FIR No. 0004 dated 31.01.2025 and take appropriate steps at the earliest. 3.

I have heard learned counsel for the parties. 6.
Keeping in view the facts and circumstances of the case and the prayer made by the petitioner, the present petition is disposed of with a direction to respondents No. 2- Senior Superintendent of Police, District Gurdaspur, Punjab to conduct free, fair and impartial enquiry in FIR No. 0004 dated 31.01.2025 under Sections 103,191(3), 190 of BNS registered at Police Station Behrampur, District Gurdaspur, Punjab in accordance with law within a period of four weeks from the date of receipt of certified copy of this order.
