The landowners are in appeal seeking enhancement of compensation for the acquired land.
Briefly, the facts of the case are that vide notification dated 5.4.1994, issued under Section 4 of the Land Acquisition Act, 1894 (for short, `the Act'), State of Punjab sought to acquire land, situated within the revenue estate of villages Badoli Gujran, Bhadak, Jakhran, Khadoli, Sardargarh, Damanheri, Pabri and Kheri Ganda, Tehsil Rajpura, District Patiala for setting up of an industrial estate of M/s Siri Ram Industrial Enterprises Limited. The same was followed by notification dated 15.6.1994, issued under Section 6 of the Act. The Land Acquisition Collector (for short, `the Collector') vide award dated 3.4.1995, assessed the market value of the acquired land of all the villages @ ` 1,45,000/- per acre. Aggrieved against the award of the Collector, the landowners filed objections. On reference under Section 18 of the Act, the learned court below assessed the market value of the acquired land of all the villages @ ` 1,75,000/- per acre. Learned counsel for the landowners submitted that the claim made in the present appeal is squarely covered by the judgment of this Court in RFA No. 1283 of 2006- Siel Industrial Estate Limited v. Darshan Singh and others, decided on 15.7.2015, whereby, compensation for the acquired land was assessed @ ` 2,10,000/- per acre.
Learned counsel for the State and respondent No.2 did not dispute the aforesaid fact.
Accordingly, for the reasons recorded in Darshan Singh' s case (supra), the present appeal is disposed of.
