H. S. Madaan, J. (Oral) Petitioner - Mohamd Khan @ Mahmud Khan, working as Clerk with Primary Cooperative Agriculture and Rural Development Bank, Ferozepur Jhirka, District Nuh, is stated to have applied to the Managing Director, of the said concern, as well as, Regional Provident Fund Commissioner, Chandigarh, for withdrawal of money from his provident fund, for the purpose of meeting expenses for the marriage of his daughter,intended to be solemnized in the near future, but his request has not been accepted. He is stated to have submitted a representation dated 13.10.2021, copy Annexure P-3, addressed to the Managing Director, Haryana State Cooperative Agricultural and Rural Development Bank Limited, Panchkula and Regional Provident Fund Commissioner, Chandigarh, respondents No. 2 and BANITA CHUGH 2021.12.07 14:51 I agree to specified portions of this document

CWP No. 24854 of 2021 -23, respectively, but that has not evoked any response, as such the petitioner has approached this Court by way of filing the present writ petition.

At the very outset, learned counsel for the petitioner states that he would be satisfied, if a direction is issued to respondents No. 2 and 3 to consider the representation of the petitioner Annexure P-3 and to take necessary action in the matter.

Keeping in view the facts and circumstances of the case and in order to avoid unnecessary litigation and to enable the respondents to consider the claim of the petitioner and then to take appropriate action, if need be, the present writ petition is disposed of directing respondents No.2 and 3 to consider the representation dated 13.10.2021 (Annexure P-3) submitted by the petitioner, as per law, rules, regulations and instructions on the subject and if some action in the matter is warranted, then the needful be done in accordance with law, within a period of two months from the date of receipt of copy of this order. A speaking order in that regard be passed, copy of which be sent to the petitioner as per registered AD Post. It is observed that in case the petitioner still feels dissatisfied after disposal of his representation, then he may approach the Court again in accordance with law for redressal of his grievances.
