(Oral) Short reply, together with Annexures R-1 and R-2, with regard to the appointment of the initiation of the arbitration proceedings as well as Award passed by the Arbitrator, has been placed on record. However, counsel for the petitioner submits that he has no knowledge about the appointment of the Arbitrator and the Award passed by the Arbitrator and that it was not required to be appointed at Delhi. Counsel for the respondents has made reference to Annexure R2, wherein there is mention made about the notice having duly sent under Speed Post/Registered Post and the necessary intimation having been given.
In the case in hand, as per the intimation given, as observed in the order dated 27.04.2023, the process in accordance with law, is being followed by the respondent. If the petitioner has any grievance with regard to the appointment of the Arbitrator as well as the seat of the Arbitration and also about no notice having been issued to him, he always has an option to raise his grievance in the form of objections, qua the Award passed. COCP-2736-2023 In the given circumstances, counsel submits that he shall resort to the appropriate remedy available to him, vis-a-vis, the Award in question and at this stage, he does not want to pursue with the present petition and the same be dismissed as withdrawn.
Ordered accordingly.
