This petition has been filed under Section 528 of BNS for quashing of order dated 29.04.2025 (Annexure P-9) passed by the ld. Addl. District & Sessions Judge, SBS Nagar vide which the bail bonds of the petitioner have been cancelled and forfeited to the State and impugned order dated 11.07.2025 ( Annexure P-10) vide which fresh non-bailable warrants are issued for 29.08.2025 against the petitioner in case FIR No. 54 dated 29.06.2018 under Sections 397,34,25 IPC registered at Police Station, City Banga, District SBS Nagar, Punjab.

Learned counsel for the petitioner submits that the petitioner could not appear before the trial Court on 03.08.2022 due to which non-bailable warrants were issued for 20.10.2022. On 20.10.2022, the petitioner appeared before the ld. Trial Court and duly explained the reason for his non-appearance which was found to be satisfactory and was accepted by the Court. Again, on 13.12.2022 the petitioner could not appear before the trial Court as he was

CRM-M-40059-2025 arrested and lodged in Central Jail, Hoshiarpur in connection with another criminal case. As such the learned trial Court issued non-bailable warrants against the petitioner and proceedings under Section 82 Cr.P.C were initiated and proclamation was ordered to be issued against him. He further submits that the petitioner may be permitted to surrender before the learned trial Court to attend the trial proceedings continuously and, therefore, requests that the impugned order may be set aside. The petitioner undertakes to appear before the trial Court regularly and shall not seek any exemption from appearance. 3.

I have heard the submissions made by the learned counsel for the petitioner and gone through the case file.

In view of the limited prayer made by the learned counsel for the petitioner, this Court does not find any legitimate ground to interfere in the impugned orders dated 29.04.2025 (Annexure P-9) and 11.07.2025 ( Annexure P-10) passed by the ld. Addl. District & Sessions Judge, SBS Nagar. However, in case the petitioner surrenders before the trial Court within 07 days from today and move application for grant of regular bail, on his doing so, the trial Court shall consider and decide the same within a period of three days. 7.

Petition stands disposed of.
