RAMENDRA JAIN, J. (ORAL) Custody certificate filed in Court today is taken on record. Through instant petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner in a case arising from FIR No.203 dated 10.07.2019 registered under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Sector 39, Chandigarh.

Petitioner is facing trial in the aforesaid FIR for having in possession of 25 injections of Buprenorphine 2 ml each i.e. 50 ml, which is a prohibited drug under the NDPS Act, besides 25 injections of Pheniramine Maleate 10 ml each.

Learned counsel inter alia contends that petitioner is a teenager and student of 10+1 class. Her mother had filed a complaint against Jaspreet Singh @ Nonu, who is the son of a Sub Inspector in Chandigarh RAVINDER SINGH 2020.03.07 14:13 I attest to the accuracy and integrity of this document

-2CRM-M-40019 of 2019 Police. Referring to orders of this Court in CRM-M-5207 of 2014 (Saleem Mohd v. State of Punjab) dated 04.11.2018 and CRM-M-8320 of 2019 (Amritpal Singh alias Billu) v. State of Punjab dated 07.05.2019, learned counsel contends that in similar cases accused have been granted bail. Therefore, petitioner also deserve the concession of regular bail. Having given anxious consideration to the facts and circumstances and recovery of commercial quantity of prohibited drug from the petitioner, this Court is not inclined to grant regular bail to the petitioner.

Facts and circumstances of the cases referred to above relied upon by learned counsel for the petitioner are different from the facts of the present case. Therefore, no benefit of the same can be given to the petitioner.

Dismissed.
