(Oral) CM-5890-CII-2023 By way of filing the instant application, the applicant/petitioner seeks listing of the main case i.e. CR-4349-2022, which is stated to be pending.

Learned counsel for the applicant/petitioner submits that vide order dated 7.10.2022, the main case i.e. CR-4349-2022 was ordered to be heard alongwith FAO No.4449 of 2022. It has been submitted that the aforesaid appeal i.e. FAO No.4449 of 2022 was listed for hearing on 11.10.2022 and upon request made by learned counsel for the appellant, the same was ordered to be dismissed as withdrawn, but the present revision PANKAJ KAKKAR 2023.08.25 18:19 I attest to the accuracy and authenticity of this document

CR-4349-2022 (O&M) ( 2 ) 2023:PHHC:111490 petition i.e. CR-4349-2022, which was ordered to be heard alongwith FAO No.4449 of 2022, remained pending as no order has been passed therein. In view of the reasons mentioned in the application, the same is allowed and the main case i.e. CR-4349-2022, which is still pending, is taken on board today itself.
