NATIONAL LOK ADALAT 531-1 FAO-6069-2017 (O&M) SIMRAN AND ANOTHER VS SURESH KUMAR AND ANR

Present:

Mr. Narender Kajla, Advocate for the appellants. Mr. Vinod Gupta, Advocate, Mr. Lalit Garg, Advocate and Mr. R.C. Kapoor, Advocate for the Insurance Company. ***** As agreed, as per statements of learned counsel for the appellants, learned counsel and representative of the respondent-Insurance Company (separately recorded), a sum of Rs.70,000/- (Seventy thousand only) over and above the amount awarded by the Tribunal is allowed to the appellants in full and final settlement of the claim in this appeal. During Lok Adalat, while arriving at a settlement, the interest of all the parties especially the minors is paramount. Accordingly, we dispose of this case with a direction to the Insurance Company to deposit the whole amount i.e. Rs.

70,000/- in the shape of two separate FDRs in the names of appellants (Minors) in equal shares, which shall be payable to them on their attaining majority. The concerned Officer of the Lok Adalat Branch/Office shall issue proper receipt after receiving the FDRs to learned counsel/representative of the respondent-Insurance Company. The appellant(s)' counsel/appellant(s) may collect the FDRs from the office of the Lok Adalat.

Copy of the order be supplied/sent to the counsel/parties and file be returned to the Hon'ble High Court.
