1. Learned counsel for the petitioners assails the order dated 29.08.2023 (P-6) whereby the Commissioner, MGNREGA has terminated the services of the petitioners who were appointed on contract basis as Additional Program Officer, Gram Rozgar Sewak and Technical Assistant.
2. Learned counsel for the petitioners submits that as per the service contract, the petitioners could be terminated from services after giving one month's notice.
3. I have considered the submissions and find that the petitioners are involved in a vigilance case registered against them where they are made accused. In terms of the service contract, the services could be terminated on one month's salary on the basis of unsatisfactory service and as per condition no.4, the petitioners have no right of continuing in MOHIT GOYAL 2023.09.13 11:39 I attest to the accuracy and integrity of this document
CWP-19700-2023 (O&M) 2023:PHHC:118885 service as a contractual employee. Moreover, as they are involved in a criminal case relating to corruption, no case for equity is made out.
4. However, the petitioners can always claim their salary if the same is not paid by filing a civil suit or by going for arbitration in terms of the service contract.
5. With the aforesaid observations, writ petition stands dismissed.
