RAJESH BHARDWAJ, J.(ORAL) Instant petition has been filed under Section 528 of Bharatiya Nagrik Suraksha Sanhita, 2023 for transfer of investigation in FIR No.157/24, dated 11.08.2024, under Sections 109, 351(3), 191(3), 190 of Bharatiya Nyaya Sanhita, 2023 and under Section 25-27-54-29 of Arms Act, registered at Police Station Ajnala, District Amritsar Rural, registered against respondents No.5 to 10 to some higher officials not below the rank of DSP, as respondent No.4 is not investigating properly and fairly and pressurizing the petitioner in connivance with respondents No.5 to 10 to compromise the abovesaid matter otherwise they will involve him in some false case, despite representations, dated 16.08.2024 and 28.08.2024, Annexures P-1 and P-2.

CRM-M-42708-2024 -2complainant in the aforesaid FIR, which is pending investigation in the Police Station Ajnala, District Amritsar Rural. She submits that petitioner has grievance against respondent No.4, who is connived with the accused and is not doing investigation rather pressurizing him to compromise the matter and hence investigation of the case be transferred to some senior Police Officer.

Notice of motion to respondents no.1 to 3-State only. On asking of the Court, Mr.Tarun Aggarwal, Sr.DAG, Punjab, who is present in Court, accepts notice on behalf of the respondents/State and submits, on instructions from ASI Bias Dev Singh, that respondent No.4 has already been transferred and thus grievances of the petitioner have been redressed.

In view of the statement made by learned State counsel that respondent No.4 has since been transferred, present petition is disposed of as grievance of the petitioner is resolved. However, respondents/Investigating Agency is directed to conduct the investigation expeditiously in a free and fair manner, in accordance with law.
