Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner, namely Balwinder Singh in case FIR No. 375 dated 09.10.2013, registered under Section(s) 135 of the Electricity Act, 2003 at Police Station APT, Jalandhar.

Learned counsel for the petitioner contended that petitioner was earlier admitted to bail in the above mentioned case and had been regularly appearing before the learned trial Court for a period of two years, but on 29.07.2019, he mistook the date and because of that, he could not appear befor the learned trial Judge. Otherwise, there was no reason for the petitioner not to appear before the learned trial Court. Now petitioner is ready to surrender before the learned trial Judge and to furnish fresh bail bonds.

Criminal Misc. No. M-39951 of 2019 General, Punjab accepts notice on behalf of the respondent. A copy of paperbook be provided to her during the course of the day. In view of above, present petition stands disposed of with the directions that in case petitioner surrenders before the learned trial Court within a period of one week from today and moves an application for admitting him to regular bail, the learned trial Judge shall release him on regular bail on his furnishing fresh bail bonds and surety bonds. However, the learned trial Judge shall be at liberty to complete the proceedings under Section 446 Cr.P.C. against the petitioner.
