Nidhi Gupta, J.(Oral) The petitioner has filed the instant petition under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of certiorari for setting aside the letter dated 28.9.2022 qua Ward No. 16, Samiti Adbar Block Nuh District Mewat (Annexure P-3) being illegal and violative of Articles 14, 15 and 243-D of the Constitution of India. Learned counsel for the petitioner submits that he will be satisfied in case the directions are issued to the respondents, especially, respondent no.4 Director General, Development and Panchayat Department, Haryana, Chandigarh to treat the present civil writ petition as representation of the petitioner and decide the same in a time bound manner, at this stage.

CWP 23213 of 2022 At this stage, Mr. Raman Sharma, Additional Advocate General, Haryana accepts notice on behalf of the respondents and on instructions, submits that the petitioner may be directed to appear before Respondent no.4- Director General, Development and Panchayat Department, Haryana, Chandigarh and undertakes that the representation of the petitioner shall be considered immediately by the respondent no.4 by passing a speaking order in the light of relevant provisions of the Articles 14,15 and 243-D of the Constitution of India. In view of the statements made by the learned counsel for the petitioner as well as the learned State counsel, we direct the respondent no.4 to consider the instant writ petition as representation of the petitioner and decide the same on 10.10.2022 itself.

The petitioner shall appear before the concerned authority at 10.30 a.m. on 10.10.2022.

The respondent no.4 shall also supply a certified copy of the order so passed by him to the petitioner on the same day. Disposed of accordingly.
