(ORAL) Petitioner prays for grant of regular bail in FIR No.364, dated 5.12.2018, registered under Section 148, 149 and 302 IPC and under Section 25/54/59 of the Arms Act, at Police Station PGIMS, District Rohtak. Learned counsel for the petitioner while referring to the FIR submits that petitioner has not caused any injury to the deceased. He further submits that the petitioner is in custody since 27.12.2018. Investigations are complete. Challan has been presented. He further while drawing attention of the Court to the order passed by the learned Additional RAJ KUMAR ARORA 2019.09.25 17:48 I attest to the accuracy and integrity of this document

CRM-M-40406-2019 Sessions Judge, Rohtak dated 2.9.2019, submits that as per the CCTV footage of the place of occurrence, petitioner was not even found present at the time of occurrence. He further submits that there is no recovery from the petitioner.

On the other hand, learned counsel for the State submits that petitioner although is not alleged to have caused any injury to the deceased but he was present at the place of occurrence with common intention.

Learned counsel for the State on instructions from ASI Udham Singh, has informed the Court that petitioner does not have any criminal background.

Keeping in view the aforesaid facts, without commenting on the merits of the case, the petitioner is directed to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of the concerned trial Court/Duty Magistrate.

Accordingly, the present petition is allowed with the aforesaid directions.
