**** ALOK JAIN, J. (Oral) Faced with the report from the Judicial Magistrate 1st Class, Amritsar, where the complainant has not appeared and has not suffered the statement qua the compromise/settlement.

Learned counsel for the petitioner vehemently argues that respondent No.2 has already benefitted from the said agreement and in fact has got re-married and is blessed with another child. Since, there is no report and there is no statement made by respondent No.2, the FIR cannot be quashed on the ground of the compromise.

Faced with the above, learned counsel for the petitioner prays for withdrawal of the present petition with liberty to file a fresh one with better particulars.

Accordingly, the present petition stands dismissed as withdrawn with liberty aforesaid.
