ARUN MONGA, J. (ORAL) Petition herein under Article 227 of Constitution of India is, inter alia, for directing the trial Court to decide an application Under Order 22 Rule 10 read with Section 1 Rule 10 CPC filed in pending Civil Suit No. 5204 of 2015 in a time bound manner. 2.

I have heard learned counsel for the petitioner and gone through the case file.

Bare perusal of the order sheet of the trial Court reveals case was adjourned thrice, since twice learned counsel for the applicant/petitioner did not address the arguments and once when the Presiding Officer proceeded on leave. This Court is unable to comprehend that, in case the grievance of the petitioner that his counsel was ready for arguments and yet it was adjourned, what stopped the counsel to give written arguments.
