-2CORAM:
HON'BLE MR. JUSTICE JAGMOHAN BANSAL
Present:
Mr. Shoryaveer Vashist, Advocate for the review applicants Ms. Rajni Gupta, Addl.A.G, Haryana --- JAGMOHAN BANSAL, J. (ORAL) 1.
By this common order, above mentioned review applications are hereby adjudicated as these have arisen out of order dated 20.05.2025. 2.
The review-applicants are seeking review of order dated 20.05.2025 passed by this Court. The operative part of order dated 20.05.2025 reads as:- " xxx xxx xxx 3.
On being confronted with the contents of communication dated 05.05.2023 of Deputy Registrar, Cooperative Societies, Kurukshetra, learned counsel for the petitioner concedes that till date no order under Section 27 of 1984 Act has been passed. He further submits that authorities may be granted liberty to pass an order, however, services of the petitioners may be protected till the date of passing adverse order, if any. 4.
Learned State counsel agrees with the offer of learned counsel for the petitioners and submits that competent authority would pass appropriate order, if necessary.
5.
In the wake of statement of both sides, the present petitions stand disposed of.
6.
It is hereby made clear that petitioners shall not be relieved till passing of adverse order, if any, by competent authority."
-32.
The non-applicants-petitioners were assailing proceedings before Deputy Registrar, Co-operative Societies, Kurukshetra. By aforesaid order, this Court has not set aside proceedings pending before Deputy Registrar. It is Deputy Registrar who has to decide fate of Resolution passed by Society. This Court has not commented on validity of the Resolution passed by Society which is under consideration before Deputy Registrar. 3.
Counsel for the review-applicants submits that it is factually incorrect that Deputy Registrar, Co-operative Societies, Kurukshetra has not decided the matter. In the instant case, the Deputy Registrar vide order dated 03.05.2023 has asked Assistant Registrar, Co-operative Societies, Ambala to take further action under Section 25 of Haryana Co-operative Societies Act, 1984 and Rule 110 of Haryana Co-operative Societies Rules, 1989. The Assistant Registrar has passed order dated 29.05.2023. 4.
From the arguments of counsel for the review-applicants, it comes out that Deputy Registrar and Assistant Registrar have already taken decision. If they have already taken decision, they are supposed to proceed as per their decision and in accordance with law. There is no ground to recall order dated 20.05.2025 because this Court has not directed the authorities to decide the matter in a particular manner or set aside the proceedings.
5.
No ground to review order dated 20.05.2025 is made out. Accordingly, the review applications are hereby dismissed. 6.
The Court is sanguine of the fact that Deputy Registrar as well as Assistant Registrar would proceed in accordance with law and do the
