PANKAJ JAIN, J. (ORAL) CM No.12506-CII of 2018 This is an application filed under Section 5 of the Limitation Act seeking condonation of delay of 100 days in filing the instant appeal. For the reasons recorded in the application, this Court is satisfied that the applicant/appellant has made out a sufficient cause for condonation of delay.

Counsels are ad idem that the matter stands settled. Insurance Company has agreed to pay an amount of Rs.20.00 lacs over and above the amount awarded by the Tribunal.

The aforesaid offer has been accepted by the claimant subject to the condition that the Insurance Company pays Rs.20.00 lacs as agreed within a period of 8 weeks from the passing of the instant order. 4.

Mr. Punit Jain, Advocate representing the respondent/Insurance Company submits that in all probabilities the amount as agreed shall be released to the claimant within a period of eight weeks. 5.

The present appeal is disposed off in terms of the settlement. 6.

It is made clear that in case, the respondent/Insurance Company fails to abide by the terms of the settlement, the same shall carry an interest of 12% per annum from the date of filing of the appeal till the date of actual realization.
