Prayer in the petition is for initiating proceedings against the respondent for intentional and willful defiance of order, Annexure P/1 dated 29.06.2021 in CWP-11191-2021.

A perusal of order Annexure P/1 dated 29.06.2021 reveals that CWP-11191-2021, was disposed of by directing the petitioner to put in appearance before the respondent/competent authority to whom representations had been made on 2nd September, 2020 and the respondent/competent Authority was directed to consider and decide the representation within two months and in case the benefit claimed was to be denied, a reasoned order was required to be passed. 3.

Learned counsel contends that the instant petition was filed on account of failure of the respondent to do the needful. 4.

Today, learned AAG has filed reply alongwith speaking order Annexure R-1 dated 09.03.2022 passed by the respondent. The same is taken on record. Copy thereof supplied to learned counsel for the

COCP-2728-2021(O&M) [2] Petitioner, who on perusal of the reply as well as order Annexure R-1 states that in the circumstances, the petitioner is not interested in pursuing the contempt petition and the same may be disposed of as such while granting liberty to the petitioner to challenge order, Annexure R-1 dated 09.03.2022 rejecting the representation filed by the petitioner by way of appropriate proceedings in accordance with law. 5.

I have considered the submissions of learned counsel and in view of the position noted above as well as statement of learned counsel for the petitioner, the instant petition is disposed of as not calling for any action against the respondent under the Contempt of Courts Act, 1971 while granting liberty to the petitioner to challenge order Annexure R-1 dated 09.03.2022 by way of appropriate proceedings in accordance with law.
