Petitioner Shiv Charan, presently working as driver in the office of Municipal Corporation, Panipat, by way of filing the present writ petition against State of Haryana through Secretary Department of Urban Local Bodies, Haryana, Department of Urban Local Bodies, Haryana, and Commissioner Municipal Corporation, Panipat craves for issuance of a writ in the nature of mandamus directing the respondents to grant him 2nd Assured Career Progression on completion of 18 years of regular service contending that he has already completed 8 years of regular satisfactory service from the date of grant of 1st ACP as per Haryana Civil Services (Assured Career Progression) Rules 2008 and as per Haryana Civil Services (Assured Career Progression) Rules 2016.

According to him, he had submitted a written representation (Annexure P8) to Commissioner, Municipal Corporation, Panipat in that regard but has not evoked any PARVINDER SINGH 2021.12.

CWP No. 25477 of 2021 response, as such he has filed the present writ petition. Keeping in view the nature of the dispute between the parties as well as prayer made by the petitioner, for the purpose of enabling respondents to consider the claim of petitioner and then to take appropriate action, if need be and further to avoid unnecessary litigation, the writ petition is disposed of directing respondent No. 3 to consider the representation (Annexure P8) of the petitioner in accordance with law, rules, regulations and instructions on the subject within a period of two months from the date of receipt of copy of the order and if some action in the matter is warranted then the needful be done in accordance with law. A speaking order in that regard be passed, which be conveyed to the petitioner as per Registered A.D. Post. For the purpose of such consideration, the present writ petition along with annexures be taken as supplementary representation by the petitioner.
