By this order, this Court shall dispose of two revision petitions i.e. CR-5995-2019 and CR-4893-2019.

Learned counsel for the parties are ad idem that the main prayer in both the revision petitions has become infructuous as the objections filed under Section 34 of the Arbitration & Conciliation Act, 1996 (hereinafter DEEPAK KUMAR BHARDWAJ 2020.03.05 11:27 I attest to the accuracy and integrity of this document

Civil Revision No. 5995 of 2019 (O&M) AND Civil Revision No. 4893 of 2019 (O&M) referred to as "the 1961 Act") stand decided by the Court of learned Additional District Judge on 05.02.2020. However, learned counsel appearing for the petitioners submits that pursuant to the award passed by the Arbitrator, some amount towards compensation for compulsory acquisition of the land has been deposited with the Court which should be ordered to be released.

On the other hand, learned counsel for the National Highway Authority of India has submitted that they intend to file an appeal against the judgment discussing objections under Section 34 of the 1961 Act. Be that as it may, once the objection petition filed by the National Highway Authority of India has been rejected, there is no impediment in releasing the amount which has been deposited. However, without commenting on merits of the case, the learned Court below is requested to consider the prayer of the land owners within ten days and pass an appropriate order.
